These services are offered on behalf of our clients ("Clients"), who use the Platform to manage their own global customer campaigns.

2. Eligibility

You must be at least 18 years old to use our Platform. By using our services, you represent and warrant that you have the authority to bind yourself or the company you represent to these Terms.

3. Client Responsibilities

Clients are solely responsible for:

The accuracy and legality of all campaign content (text, images, offers, targeting)
Obtaining consent from their own customers where legally required (e.g., for email/SMS/WhatsApp marketing)
Complying with applicable laws including GDPR, CCPA, CAN-SPAM, TCPA, and Meta and TikTok advertising policies

4. Account Security

Clients are responsible for maintaining the confidentiality of their account credentials and for all activity under their accounts.

5. Prohibited Uses

Clients may not use our Platform to:

Promote illegal, fraudulent, or deceptive content
Harass, abuse, or threaten individuals or groups
Distribute malware or attempt unauthorized access to any system
Violate the rights of any third party including intellectual property rights

6. Payment and Fees

Clients must pay all applicable fees as outlined in their service agreement. Failure to pay may result in suspension or termination of services.

7. Intellectual Property

All technology, content, trademarks, and materials on the Platform are the property of Kintah LLC or our partners. Clients retain ownership of their uploaded content, but grant us a license to use it solely to deliver the agreed services.

8. Termination

We reserve the right to suspend or terminate access to the Platform at our discretion, including if a Client violates these Terms or applicable law.

9. Disclaimers

The Platform is provided on an "as-is" basis. We do not guarantee results, uptime, or uninterrupted access. Kintah LLC disclaims all warranties, express or implied.

10. Limitation of Liability

To the maximum extent permitted by law, Kintah LLC is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services.

11. Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict of law principles.

12. Changes to Terms
